Opposition: Commissioner McGrath confirmed that the change of the constitution means a violation of EU law

Bratislava – The amendment to the Constitution of the Slovak Republic means a violation of EU law for denying the principle of its supremacy over national law. In a letter published on Tuesday by opposition MP Mária Kolíková (SaS), this is claimed by European Commissioner for Justice Michael McGrath, TASR reports.
“The European Commission has clearly warned the Slovak authorities that the proposed amendment to the constitution in Article Seven, Paragraph Six and Paragraph Seven, as adopted in the first reading on April 9, 2025, raises concerns regarding the principles of the supremacy of European law,” McGrath wrote in a letter quoted by the former Minister of Justice of the Slovak Republic.
Kolíková reached out to Commissioner McGrath with a letter requesting information on how the European Commission perceives the government’s constitutional amendment. She did so, according to her own words, after Justice Minister Boris Susko (Smer-SD) was unwilling to inform the members of the National Council of the Slovak Republic about the European Commission’s stance on the constitutional amendment. Commissioner McGrath sent a letter to the Slovak government in this regard on June 13.
According to the government proposal, the constitution is to enshrine two genders – male and female. It is also to include the guarantee of equality between men and women in terms of remuneration for work. The constitutional law will also address child adoption and the right of parents to decide on their children’s participation in the educational process. With this proposal, the government aims to achieve Slovakia’s sovereignty in value and cultural-ethical issues. MPs from KDH and the Christian Union (KÚ), who are part of the Slovakia, For the People, KÚ club, have already announced that they have reached an agreement on a joint amendment proposal with the coalition.
