Denmark may be on its way to winning the case about state aid for the Fehmarn Belt
Denmark may be on its way to victory in the case concerning the Femern Belt.
In any case, the Advocate General of the EU Court of Justice is siding with Denmark on Thursday in the case regarding state aid for the fixed connection under the Femern Belt.
The case arose because Denmark has supported the company behind the connection with a number of capital injections, state loans, and state guarantees.
The EU Commission ruled in 2020 that this constituted state aid. However, the Commission simultaneously stated that it was compatible with the internal market.
Denmark has filed a lawsuit to have the claim of state aid annulled.
The court initially rejected that application in 2024. It was then appealed to the EU Court.
In the draft ruling, the Advocate General of the EU Court recommends that Denmark be upheld:
– Based on the above considerations, I propose that the Court uphold the appeal and annul the Commission’s decision (…) regarding Denmark’s state aid, writes the Advocate General.
